    Using declared VAT for payroll or suppliers changes the risk. The business needs a formal payment route, a cash forecast, and a clear record of each decision.

    Businesses that file a VAT return but do not pay the declared amount still have an unpaid tax debt. VAT normally must reach the tax authority within one month after the return period ends. A correct return does not extend that deadline. Paying payroll, suppliers, or other bills first increases financial and enforcement risk.

    Why this matters

    Filing records the VAT due. Payment clears the debt. Until the money arrives, the debt remains open. Late payment can trigger a 3% payment-default penalty. Repeated late payment can lead to a penalty of up to 10%, within the published maximum of €6,709. A 2022 ruling shows that a payment-default fine may not end the matter where facts support intentional non-payment. Bank records and payment decisions can show how management handled the shortage.

    Example

    A company files a VAT return showing €12,400 due. Its bank balance is €9,000. Payroll leaves tomorrow, and a supplier has stopped deliveries. Management pays payroll and the supplier. The VAT remains unpaid. The ledger is correct, but the cash decision needs a record. Keep the VAT period, due date, cash shortage, approved payments, and names involved in one file. Add any extension request, response, payment terms, and revised cash forecast. Do this before a reminder arrives.

    XTROVERSO tips

    • Match every return to the bank. List each filed VAT return with its amount, deadline, bank receipt date, and unpaid balance. The date you start a transfer is not the payment date.
    • Separate VAT in the cash forecast. Show declared VAT on its own line. Include expected VAT, overdue customer invoices, payroll, rent, and essential supplier payments for the next 13 weeks.
    • Use a formal payment route. If cash will not be available, promptly request a payment arrangement or extension. Keep the request, response, terms, and payment evidence in one file.
    • Record the management decision. Record who approved using cash for other bills, which bills were paid, and how the VAT debt will be cleared. Add dates and supporting figures.
    • Check duties linked to the legal form. A qualifying legal entity may have a separate duty to report inability to pay. That differs from a request for payment extension. Check the deadline before it passes.
    • Fix the cash problem underneath. Review customer payment terms, overdue invoices, prices, margins, private withdrawals, and recurring costs. Do not use VAT from the next period to pay the previous one.
