    A suspension does not automatically close digital access. Employers need clear instructions, preserved evidence and a dismissal process that matches the facts.

    Sending confidential work files to a private email address after suspension can support summary dismissal in the Netherlands. The result depends on the instruction, evidence, timing and the full employment context. Digital access left open after suspension can affect data security and exit costs.

    Why this matters

    Suspension creates an employment file and a security file. Email, shared drives and remote login may stay active after an employee returns a building pass. That can expose payroll records, customer contracts, staff files, prices and supplier details. For summary dismissal, the employer needs an urgent reason, prompt action and prompt communication. The dismissal letter must match the records.

    Example

    A payroll firm suspends an administrator after a serious conflict. The administrator returns the office key but can still open the shared drive from home. Before changing the account, the firm saves login records and checks mailbox forwarding. It identifies the payroll files opened or transferred. The employer records the facts, asks for the employee’s response and obtains employment-law advice before deciding on dismissal.

    • Treat suspension as a security event. Check the building pass, email, cloud folders, remote login, shared drives, business apps and mobile devices. Record who closes each access route and when.
    • Preserve records before changing accounts. Keep relevant login logs, mailbox data and file histories. Deleting an account immediately may remove evidence needed for the employment file.
    • Give a clear written instruction. State whether the employee may access systems, files, customers or colleagues. Do not rely on a vague statement about lost trust.
    • Match the dismissal letter to the evidence. Describe the conduct, files, instruction and timing precisely. Do not add allegations that available records cannot support.
    • Include costs in the plan. Allow for legal advice, IT investigation, replacement staff and a possible transition-payment dispute. Summary dismissal does not guarantee a cheap exit.
