    A Dutch court upheld an immediate dismissal involving sport during sickness. The case shows why capacity, conduct and trust require separate handling.

    A Dutch court has upheld the immediate dismissal of an employee who joined a demanding sports event while off sick. The case separates medical capacity, employee conduct and loss of trust.

    Why this matters

    One disputed sick leave file can disrupt the roster, payroll, customer work and staff relations. Sport can raise questions, but it cannot settle whether someone can do contracted work. The occupational physician assesses capacity and restrictions. Management handles conduct, communication, suitable work and agreed actions. Employees usually have dismissal protection during their first two years of sickness. Immediate dismissal remains exceptional and depends on the full file.

    An employee reported sick, saying slight exertion caused severe fatigue. She later completed a Hyrox event. The court weighed this against her explanation, conduct and a strained employment history. It upheld immediate dismissal. The employer acted quickly, heard her response and stated the reason clearly. She still received a transition payment and back pay. The employer received €2,106 gross in reduced fixed compensation.

    • Record facts, not conclusions. Save the date, message, image or other observation. Note where it came from. Do not state that the employee is fit for work.
    • Check the existing file. Compare the observation with earlier statements, agreed actions and suitable-work arrangements. Keep medical details out of management messages and payroll records.
    • Ask for an explanation. Describe the apparent inconsistency and let the employee respond. Record the question, answer and date. Do not ask for a diagnosis.
    • Keep reintegration moving. Maintain the problem analysis, plan of action and progress reviews. Record suitable work that was offered, accepted, declined or adjusted.
    • Use the professional route. Send questions about medical capacity to the occupational physician. Consider an official expert opinion if capacity, suitable work or reintegration remains disputed.
    • Review before dismissing. Read the timeline, evidence, employee response, contract and legal basis as one file. Immediate dismissal requires prompt action and a precise reason.
