  • Dutch Cao Independence: What Employers Should Check

    A proposed Dutch independence rule focuses on who negotiates a cao. Employers should check how current cao terms reach payroll, contracts, prices, and cash.

    A Dutch consultation opened on September 22, 2026, on a bill requiring collective bargaining parties to be independent. It closes on October 19, 2026. The bill remains in preparation, with an intended 2028 start. A collective labor agreement, or cao, can set terms for employers and workers outside the negotiations.

    Why this matters

    A sector cao can be declared generally binding. Its wages, allowances, working hours, leave rules, and notice periods may then apply to employers that did not sign it. The proposal gives courts clearer criteria when independence is disputed. They can examine the party’s internal organization, its history, and its conduct during bargaining. Payroll does not change today. The current cao and its amendments still shape payroll, staffing, customer prices, and cash forecasts.

    A new wage table reaches an employer after customer contracts are signed. The basic wage is clear, but an allowance has changed. Payroll must use the right start date and worker group. The manager checks the roster. The owner checks whether agreed prices still cover the hours. That one cao amendment affects payroll, margin, cash, and customer planning.

    XTROVERSO tips

    • Confirm which cao applies. Record whether the basis is employer-organization membership, sector scope, a generally binding declaration, or a company agreement. Check each Dutch employing entity separately.
    • Keep a dated cao file. Save the applicable agreement, scope clauses, wage tables, amendments, and implementation dates. Keep the version used for every payroll period.
    • Compare the text with payroll. Check wage scales, contracted hours, overtime, allowances, leave, and sector-specific terms. Record each correction and its effective date.
    • Calculate the full cost. Include pension costs, premium hours, absence cover, leave, and changes in billable capacity. The published wage increase is only one part of the cost.
    • Connect changes to contracts and cash. Put known cao changes into pricing, tenders, staff planning, and cash forecasts before they reach payroll.
    • Document bargaining when involved. If your organization takes part in bargaining, keep records of authority, counterparties, meetings, and final decisions.
