    AI speeds up employment-law drafting. A transition-payment claim still depends on contracts, payroll, hours, termination records and a clear calculation.

    AI tools can now produce formal Dutch employment claims quickly. Their legal weight still depends on contracts, payroll, hours, termination records and a clear calculation. That matters when transition-payment deadlines leave little time to assemble a missing personnel file.

    Why this matters

    Employees usually qualify for a transition payment when an employer dismisses them or does not renew a fixed-term contract. Pay depends on earnings and service period. In 2026, the maximum is €102,000 gross, or one gross annual salary if higher. Payment is generally due within one month. A stand-alone court request has three months. Missing documents delay claims and disrupt cash planning. Proposed 2027 changes still need parliamentary approval.

    A logistics company has twelve staff on variable rosters. Its payroll provider holds the signed contract, while the manager keeps the hours record. A pay rise was agreed by email. The founder sent the final termination message. When a transition-payment claim arrives, nobody has the complete file. Payroll shows the correct salary, but the contract amendment is missing. The adviser must rebuild the employment history before assessing the claim.

    XTROVERSO tips

    • Put each departure in one file. Keep the signed contract, amendments, hours, payslips, termination correspondence and calculation together. Record the formal end date and final working day separately.
    • Match payroll to the contract. Check every change in pay, hours or role. The payroll record and signed documents should show the same terms.
    • Show the calculation trail. Record the wage basis, service period and payment date. An adviser should be able to check the calculation without guessing.
    • Set one owner for the file. Managers, payroll providers and advisers may each hold records. Give one person responsibility for collecting the full employment history.
    • Plan the cash before employment ends. Add expected transition payments to the cash forecast. Review long-term sickness and closure files that may be affected by the proposed 2027 changes.
