  • Mortgage Fraud Risk Reaches Beyond the Mortgage File

    Mortgage fraud can reach contractors, advisers and property firms when ownership, instructions and payments do not match the formal file.

    Mortgage fraud in the Netherlands is increasingly linked to wider criminal structures. False income records, straw persons, legal entities, hidden intermediaries and third-party payments can hide who funds, controls or benefits from property. Unclear ownership and payment trails can affect businesses working around a building.

    Why this matters

    One firm may hold the contract, another may pay, while a manager deals with the tenant. That split can hide who directs or funds a property deal. In 2025, FIU-Nederland designated 92,043 transactions as suspicious. About 17,000 had a fraud component. A separate FIU review identified 2,000 suspicious third-party payments to Dutch businesses, worth €300 million. When the customer, invoice and payer differ, refunds, VAT, insurance and debt recovery can become harder. Wwft-obliged firms may also need customer checks, UBO identification, monitoring and reporting.

    Example

    A renovation company contracts with a property owner. An adviser gives instructions, but an unrelated company pays the first invoice. The customer then asks for a different project description on later invoices. The file needs a clear explanation. Record the adviser’s authority, the reason for the payment and the work completed. Before issuing a refund, establish who is entitled to receive it.

    XTROVERSO tips

    • Match the contract, invoice and payment. Check that the customer name, work description, payer and payment reference fit together. Record the reason for any difference.
    • Record each person’s role. Note who introduced the parties, negotiated, gave instructions, signed, paid and benefits from the property.
    • Ask about third-party payments. Ask why another person or company pays the invoice. Keep written authority and the commercial reason in the file.
    • Check ownership against actual control. Use company and UBO records where relevant. Also record who makes decisions, provides funding and receives the economic benefit.
    • Test one real file. Choose a recent property transaction. Ask whether a colleague can reconstruct it without relying on memory or one employee’s private notes.
    • Escalate unexplained changes. Pause when the payer, invoice description, contact person or stated property use changes without a clear reason. Wwft-obliged firms should follow their monitoring and reporting procedure.
