  • Cross-Border Founders Need One Clear Tax Record

Cross-border founders need consistent records for residence, foreign accounts, tax returns and money moving between private life and the company.

Dutch tax residence follows the facts of a person’s life and work. A foreign address does not settle the position. Dutch authorities receive foreign financial data and compare it with income-tax returns. Differences between residence, account records and tax filings can lead to questions.

    Why this matters

Residence sets the starting point for the Dutch tax return. A Dutch resident generally reports worldwide income and relevant foreign assets. A non-resident may have a narrower Dutch tax scope. An additional assessment can tighten private cash. It may affect dividend requests, shareholder loans or director’s current-account withdrawals. Foreign accounts are lawful. The owner, balance, source of funds and tax return must match. Transfers involving a BV need documents and matching ledger entries.

    Example

A founder is registered in Germany, works regularly in the Netherlands and has homes in both countries. The founder also holds a foreign investment account. A residence review considers stays, work, family ties, available homes and economic activity. The 1 January balance must match account statements, ownership records and the tax return. A payment to a Dutch holding company needs a legal basis. It may be a loan, capital contribution, dividend repayment or private expense. The payment reference does not decide the treatment.

    XTROVERSO tips

    • Map the residence facts. List available homes, registrations, work locations and recurring stays. Include family and care responsibilities. Keep travel records if two countries could claim residence.
    • Check declarations made to banks. Compare the tax residence declared to each bank with the Dutch return. Explain and correct differences where needed.
    • Build a 1 January asset file. Collect statements for each foreign bank, savings and investment account. Record ownership, balances and the euro conversion used in the return.
    • Trace money moving through the company. Match each material transfer between a private account and the BV to a contract, decision or invoice. Use the same treatment in the ledger.
    • Keep private and company records separate. Private investments belong in the private asset file. Company cash belongs in the company ledger. Document every payment crossing that boundary.
    • Use the rules for the correct tax year. Box 3 rules have changed. Do not use current percentages for an older tax year. Review each year under the rules that applied then.

Ask XTROVERSO to organise the records before your next return, transaction or tax query
