  • Dutch Data Platforms Must Prove Their Neutral Role

    Dutch DGA decisions put data platform neutrality under closer review. Contracts, access, product design, and revenue must match the role claimed.

    Dutch supervision of data intermediation services is producing case-by-case registration decisions under the EU Data Governance Act. The decisions test whether a platform’s contracts, product design, ownership and revenue model support its claimed neutral role.

    Why this matters

    A data intermediary brings parties together to share data commercially without taking rights in that data. Its daily records must support that role. A website may promise neutrality while a contract allows analytics or reuse. Staff, suppliers, or group companies may have wider access than customers expect. Those gaps can slow sales, financing, and customer checks. The optional EU label requires fuller evidence on independence, access rules, security, and limits on data use.

    Example

    A platform charges suppliers and customers to exchange operational data. It then plans to sell benchmarks based on pooled records. Before development starts, the company needs to check data rights, contract terms, and access to raw files. It should also separate intermediation income from analytics income. The plan may require a separate product, tighter access controls, or different contracts.

    XTROVERSO tips

    • Map the data path. Write down who supplies the data, who receives it, and what the platform does in between. Include each file, system, and supplier.
    • Compare your business records. Put the website, sales deck, contracts, and technical description side by side. Mark every difference in the role you claim.
    • Check the right to share. Confirm that each supplier, employer, customer, or member can provide the data. Keep supporting evidence in the customer file.
    • Review access and reuse. List staff, suppliers, and group companies that can view raw data. Record any use for analytics, AI, scoring, or product improvement.
    • Test planned changes early. Review new dashboards, benchmarks, investors, and revenue streams before approval. Check whether the neutral role still fits the service.
