Dutch payroll tax guidance draws a clear line around backdated staff allowances. A fixed allowance set after staff incurred the costs cannot be tax-free for earlier months. Timing affects wage tax, WKR capacity and the employer’s final cost.
Why this matters
A payroll code does not decide the tax treatment. Dates, staff entitlement and supporting records do. Past costs may still be reimbursed tax-free when the employer can prove them. Without evidence, the payment may become taxable wage. It may use the WKR discretionary margin if designation conditions are met. For 2026, the margin is 2.00% of taxable wages up to €400,000 and 1.18% above that. Excess use triggers an 80% employer levy.
Example
In the published case, an employer decided in September 2025 to pay €50 per month from April 2025. A cost study ran from September through November. The employer paid the accumulated amount in December. Although plausible, the amount could not cover earlier months as a fixed tax-free allowance. Staff had incurred the costs before the study was complete. Evidenced actual costs required a separate assessment.
XTROVERSO tips
- Put the dates next to each other. Record the decision date, effective date, cost period and payment date. The timeline shows whether the file covers past costs or a future allowance.
- Separate past and future payments. Use one file for evidenced costs already incurred. Use another for a fixed allowance covering future costs. Do not put both under one payroll code.
- Check the supporting records. Keep receipts, declarations, calculations, contracts and written staff policies. For earlier years, check whether staff already had an unconditional right to reimbursement.
- Review the WKR before paying. Ask payroll for the remaining discretionary margin. Include gifts, events and other staff benefits already recorded during the calendar year.
- Check special allowance rules. Fixed travel and home-working allowances have separate statutory rules. Do not apply them automatically to tools, parking, telephone or other staff costs.
- Keep payroll and the ledger aligned. The decision, payroll record and ledger entry should describe the same payment. Set a review date when work or travel patterns change.
